I currently have a fully functional SBS 2003 - I am planning to install new servers running win2012 servers.  My issue is that the current server has ADP payroll running on it and my company no longer uses ADP BUT wants to be able to access the old data. So, is there any way that the sbs2003 can be left on the network after the move of all other data to the new server?

    many thanks

Not if you are transferring the AD roles. Keeping SBS on the network after that point is a licensing violation.

When you look at the pricing of SBS, it is significantly cheaper than if you were to buy the individual components and build a similar setup. The *reason* you get such a discount is because you agree that it will be used in only certain types of setups and used in a very specific way. One of the things you agreed to (when you typed in the license key and hit "I Agree" is that the SBS server would be a domain controller and hold all FSMO roles. Thus transferring any of the roles, or removing the ADDS role and making it a member server, violates that agreement.
